Gay Marriage

I've watched the Keith Olberman comment- and love it.
Hubby and I were talking about this at lunch, and he proposed a different tactic- argue the banning of gay marriage as a violation of the First Amendment. Essentially- freedom to practice their religion.
There are churches that accept gay marriage, and that are willing to perform the ceremonies. Stating that gay marriage is illegal- violates their right to practice their religion.
We didn't have much of a chance to really discuss this idea, or if it was viable so- Thoughts?
